John D. Waddell, Q.C.
COMMERCIAL MEDIATOR, ARBITRATOR, CIVIL LITIGATION
John Waddell has been practicing law for over 35 years. He has been involved in leadership roles with the organized Bar in British Columbia and nationally for 30 of those years.
John has practiced law as a trial lawyer in Victoria, B.C. since 1981 and was a founding partner of Waddell Raponi LLP from 1986 to the end of 2017. He is now Associate Counsel with that same firm and restricts his practice to mediations, arbitrations and mediations/arbitrations (“Med-Arbs”).
He has conducted litigation in criminal, administrative, and civil matters of all sorts, save family law. He has always been a generalist. The length and breadth of his experience eventually led him to serving as an investigator, hearing panel chair, mediator and arbitrator. His enjoyment and commitment to dispute resolution led him to become certified as a member of the Civil Mediation and, more recently. Mediation/Arbitration Rosters, maintained by Mediate BC. John has also been appointed as mediator and arbitrator by the BC International Arbitration Centre on a number of occasions.
As a mediator, John has helped resolve disputes in BC and Alberta since 1999. He has had extensive experience with personal injury, employment, estate, construction, shareholder’s dispute, professional association, real estate, leasing, government and public body and general civil litigation disputes. He has particular expertise in multi-party mediations and has found his roles as President and Chair of many organizations at the provincial and national level to have afforded him the skills to organize and preside over multiple party mediations and arbitrations.
As an arbitrator, John has served as a sole arbitrator, and as both a member and Chair of three member arbitration and disciplinary hearing panels, for almost 20 years. He has made decisions in commercial leasing, franchise, contract, employment, Underinsured Motorist Protection, construction, real property purchases and sales and shareholder disputes. He is efficient, composed and a practiced observer and listener. He has received training in the management of hearings, and the writing of decisions through Continuing Legal Education BC, the BC Arbitration and Mediation Institute and in his capacity as a member of the Law Society of BC Discipline Hearing Panels.
John has been on the list of Special Prosecutors in BC since 2005. This assignation has required John to exercise a dispassionate approach to determining what evidence is relevant and admissible. It also requires him to be publicly accountable for his decisions and to articulate them in his written assessments as to what satisfies the public interest, and what offers a substantial likelihood of conviction.
John has provided legal advice to the Chief Electoral Officer of BC for over 30 years. This opportunity has required him to understand the role of a non-partisan Officer of the Legislature and to analyze issues of public importance through a neutral lens.
In acting as a mediator or decision maker, John understands the need for timely and cost effective results. He is a firm believer in the value of both mediation and arbitration as effective means of solving problems and disputes.
